Irrespective of the value of your assets, you have the right to decide who will manage your estate after your death, and how your assets will be distributed. Armed with a properly drafted will, the division of you assets can be made in a planned manner according to your wish, in a tax effective manner, combined with the fact that there will be a trustee or an executor chosen by you, who will have the right to deal with the assets in your estate immediately upon death. Remember that there are significant tax consequences at the time of death due to deemed disposition of assets.
Create your own plans while you can. A properly drafted Will allows you to design how your assets can be distributed in a manner which is ideal for you. In particular, you can provide for the welfare of your family and ensure the efficient management of your property by a trusted person, designated by you.
An ideal estate plan may include two other types of documents: continuing powers of attorney for property, in which you can name the person(s) to handle your financial matters in case of your incapacity; and a personal care powers of attorney for health care, in which you similarly name the person(s) to make medical decisions on your behalf.
